    Tipping Off

    Tipping off is the UK criminal offence of disclosing to a third party that a Suspicious Activity Report has been made, or that an investigation is contemplated or in progress, where the disclosure is likely to prejudice the investigation.

    The offence carries up to 2 years imprisonment and an unlimited fine. The risk is most acute in regulated firms — telling the client "we've had to make a report about you" is the textbook example, but more subtle disclosures (refusing to continue acting without proper explanation, mentioning to a colleague who then leaks) can also trigger the offence. The safe rule: after filing a SAR, behave externally as if nothing has happened, and take advice before any communication that touches on the subject of the report.
