    Section 8

    A Section 8 notice is the "fault-based" eviction route in England and Wales by which a private landlord recovers possession from an AST tenant on one or more specified grounds — most commonly rent arrears, anti-social behaviour, or property damage.

    There are 17 possible grounds; some are mandatory (the court must order possession if the ground is proved — e.g. 2 months' rent arrears under Ground 8), others are discretionary. Notice periods vary by ground from 2 weeks to 2 months. Unlike Section 21, Section 8 will remain available after the Renters' Rights Bill — with some grounds strengthened, others removed, and additional grounds added for landlord sale and family occupation.
