    Section 21

    A Section 21 notice is the "no-fault" eviction route in England and Wales by which a private landlord can recover possession of a residential property at the end of an Assured Shorthold Tenancy, without having to prove the tenant has done anything wrong.

    A valid Section 21 notice gives the tenant at least 2 months' notice to vacate (extended during certain protection periods). The notice is only valid if the landlord has met preconditions: deposit protected within 30 days, EPC and Gas Safety Certificate served, How to Rent booklet given, and (in licensed HMO or selective licensing areas) a valid licence held. The Renters' Rights Bill, expected to pass in 2025/26, will abolish Section 21 entirely — replacing AST with a new periodic tenancy structure under which landlords need a specified ground to evict.
