    Selective Licensing

    Selective licensing is a UK regime under which a local authority can require every privately-rented property in a designated area to hold a council-issued licence, regardless of the property's HMO status.

    A selective licensing scheme requires Secretary of State approval (for schemes covering more than 20% of the area or 20% of rental properties) and runs for up to 5 years. Conditions typically include fit-and-proper-person checks on the landlord, gas and electrical safety, fire safety, and proper management arrangements. Operating an unlicensed rental in a selective area is a criminal offence with unlimited fines — and Rent Repayment Orders can require up to 12 months' rent back to tenants.
