    Genuine Vacancy

    A "genuine vacancy" is the Home Office requirement that a role being sponsored must be a real position that genuinely exists, with the duties and salary matching the Certificate of Sponsorship description — not a constructed role to provide visa cover.

    UKVI tests genuineness through audits and Refusal of Permission decisions. Red flags include: a role with duties wildly above or below the SOC code description, a salary that exactly matches the going rate (suggesting it was reverse-engineered), a one-person company sponsoring itself, or a shell-like business with no operational substance. Findings of non-genuine vacancy typically lead to immediate licence revocation and may bar the company from re-applying for cooling-off periods.
