    Civil Penalty Illegal Worker

    Glossary

    Civil Penalty (Illegal Worker)

A civil penalty for employing an illegal worker is the financial penalty UK Visas and Immigration can impose on a UK employer who is found to be employing someone without the right to do the work — up to £45,000 per worker for a first offence and £60,000 per worker for repeat offences.

The penalty applies whether or not the employer knew about the breach — it's a strict-liability offence. The only complete defence is a "statutory excuse": evidence that a compliant right to work check was carried out before the worker started, retained, and refreshed where appropriate. UKVI publishes the names of employers fined every quarter on GOV.UK — public-record reputational damage often exceeds the financial penalty itself.
